courts still enforce most arbitration agreements. There are
several reasons why employers are better off arbitrating
employment disputes than going to court as this
presentation will demonstrate.
• Recognize the pros and cons of mandatory arbitration
of employment disputes
• Learn how to write an arbitration agreement that the
courts will enforce
• Know when to implement arbitration agreements so as
to attract the least resistance
• Be aware of legislative attempts to restrict arbitration
of employment disputes
